Using a tax representative for VAT in Switzerland

Foreign companies with a turnover of at least CHF 100,000 in Switzerland and worldwide must register for Swiss VAT with the Federal Tax Administration (FTA).

This provision, which came into force on 1 January 2018, is accompanied by the obligation to appoint a tax representative established in Switzerland for taxable foreign companies that do not have a domicile, registered office or permanent establishment on Swiss soil. In order to meet this legal requirement, we offer our services to support the development of your company by becoming your tax representative in Switzerland.

VAT tax representative in Switzerland: who needs one?

According to the new provisions of the Swiss VAT Act, which came into force on 1 January 2018, all foreign companies providing services or supplies subject to tax in Switzerland are legally obliged to be subject to VAT. From now on, VAT liability is no longer established on the basis of a turnover of CHF 100,000 (approximately EUR 10,000) generated in Switzerland, but on the basis of a worldwide turnover of CHF 100,000, provided that part of the turnover is generated in Switzerland. To meet this legal obligation, foreign companies that do not have a domicile, registered office or permanent establishment in Switzerland must also appoint a tax representative with their registered office in Switzerland.

A prerequisite for being able to register in the taxpayers’ register, the tax representative in Switzerland manages the declaration formalities with the federal tax authorities on behalf of the foreign company. As part of its mandate, My Swiss Company SA takes care of: creating the VAT registration file with the AFC (Federal Tax Administration); filing declarations on time as soon as it is in possession of the necessary documents; paying the tax due as well as processing communications with the tax authorities.

An advantageous and stable tax environment

Switzerland, by the quality of its services and its discretion, has managed to become a world financial centre. This dependability is a strong point which makes Switzerland attractive for businesses.

Switzerland groups 26 cantons, each with its own tax system. Consequently, taxation is not the same throughout the territory. It is important each time to consider federal, cantonal and communal taxation. However, in general the overall tax burden in Switzerland is relatively light compared to its direct neighbours, with, in addition, access to a financial and banking infrastructure and environment often envied elsewhere in the world.

The Swiss tax system offers numerous possibilities for optimisation. Our fiduciary shows you how to benefit from these.

Indeed, each of your decisions will have tax consequences. It is therefore necessary to know the various consequences in order to anticipate and orientate your choices in tax matters.

We act on several profiles:

  • Tax advice for private individuals
  • Tax advice for businesses
  • International tax advice
  • Advice on VAT in Switzerland and the European Union
  • Advice on royalty management

It is therefore a question of using all the possibilities offered by the Swiss and European tax system for entrepreneurs and shareholders of Swiss and international companies.
